4.4 loss damage or expense caused by inherent vice or nature of the subject-matter insured
4.5 loss damage or expense proximately caused by delay, even though the delay be caused by a risk insured against (except expenses payable under Clause 2 above)
4.6 loss damage or expense caused by insolvency or financial default of the owners managers charterers or operators of the vessel where, at the time of loading of the subject-matter insured on board the vessel, the Assured are aware, or in the ordinary course of business should be aware, that such insolvency or financial default could prevent the normal prosecution of the voyage
This exclusion shall not apply where this insurance has been assigned to the party claiming hereunder who has bought or agreed to buy the subject-matter insured in good faith under a binding contract
4.7 loss damage or expense arising from the use of any weapon of war employing atomic or nuclear fission and/or fusion or other like reaction or radioactive force matter.
4 本保险在任何情况下均不承保
4.1 可合理归因于被保险人故意赎职的灭失、损害或费用
4.2 保险标的通常重量或体积损失或通常磨损

4.4 保险标的的固有缺陷或性质造成的灭失、损害或费用
4.5 近因是迟延造成的灭失、损害或费用,即便该迟延是由于某种承保危险引起的(根据上述第2条支付的费用除外)
4.6 因船舶所有人、经理人、承租人或经营人的破产或财务困境造成的灭失、损害或费用,如果在保险标的装上船舶时,被保险人知道或在其通常业务中应当知道此种破产或财务困境可能阻止该航程的正常进行。
如果本保险已转让给根据有约束力的合同善意购买或同意购买保险标的而根据本保险提出索赔的当事方,本除外不适用。
4.7 因使用原子或核裂变和/或核聚变或其他类似反应或放射性力量或物质所制造成的战争武器引起的灭失、损害或费用。
本除外遵循标准模式,但应注意下述与协会货物保险B条款用语的不同之处:
(1) 第4.2款未提及“通常渗漏”因为天然橡胶保险条款无意于用作液态胶乳的运输保险。
(2) 第4.6款(“破产”条款)已按我们在有关协会商品贸易保险条款的注释修定(见第63页至64页)。
(3) 删除了“故意损害条款(协会货物保险B条款(4.7))。
第5条 不适航与不适运除外条款(Unseaworthiness and Unfitness Exclusion Clause)
5.1 In no case shall this insurance cover loss damage or expense arising from
5.1.1 unseaworthiness of vessel or craft or unfitness of vessel or craft for the safe carriage of the subject-matter insured, where the Assured are privy to such unseaworthiness or unfitness, at the time the subject-matter insured is loaded therein
5.1.2 unfitness of container liftvan or land conveyance for the safe carriage of the subject-matter insured, where loading therein is carried out prior to attachment of this insurance or by the Assured or their servants.
5.2 Where this insurance has been assigned to the party claiming hereunder who has bought or agreed to buy the subject-matter insured in good faith under a binding contract, exclusion 5.1.1 above shall not apply.
5.3 The Underwriters waive any breach of the implied warranties of seaworthiness of the ship and fitness of the ship to carry the subject-matter insured to destination.
5.1 本保险在任何情况下均不承保因下列原因引起的灭失、损害或费用
5.1.1 船舶或驳船不适航或船舶或驳船不适合安全运送保险标的,如果被保险人在保险标的装上船时,对此种不适航或不适运实际知情。
5.1.2 集装箱、托盘、或陆上运输工具不适合安全载运保险标的,如果向其装货发生于本保险责任开始之前,或是由被保险人或其雇员所为。
5.2 如果本保险已转让给根据有约束力的合同已善意购买或同意购买保险标的根据本保险提出索赔的当事方,上述5.1.1 项除外不适用。
5.3 保险人放弃任何违反船舶适航及船舶适宜载运保险标的至目的地的默示保证。
本条已按我们根据协会商品贸易保险条款作的解释修定(见第63至64页)。
第6和7条 战争与罢工除外条款
此两条与协会货物保险条款规定相同。
第8条 运送条款(Transit Clause)
8.1 This insurance attaches from the time the goods leave the warehouse or place of storage at the port of shipment named herein for the commencement of the transit and continues during the ordinary course of transit until the goods are delivered to a warehouse or place of storage at the port of destination named herein and, provided it is not a manufacturer’s warehouse or place of storage, whilst there for a period not exceeding 30 days.
8.2 If the goods are to be forwarded to a place outside the limits of the said port of destination the insurance continues until the goods are loaded on to a vessel, craft or conveyance or until the expiry of 30 days from midnight of the day on which the discharge overside of the insured goods from the oversea vessel at the said port of destination is completed, whichever shall first occur.
8.3 By giving notice to the Underwriters before the insurance ceases the Assured may obtain an extension at a premium to be arranged to cover the goods beyond the limits in 8.1 and 8.2 above.
8.4 This insurance shall remain in force (subject to termination as provided for above and to the provisions of Clause 9 below) during delay beyond the control of the Assured, any deviation, forced discharge, reshipment or transhipment and during any variation of the adventure arising from the exercise of a liberty granted to shipowners or charterers under the contract of affreightment.
8.1 本保险责任始于货物在载明的装运港离开仓库或贮存处所开始运送之时,在通常的运送期间持续,直至货物在载明的目的地交付到仓库或贮存处所,如果其不是制造厂商的仓库或贮存处所,则在此处存放不超过30天。

8.4 在被保险人不能控制的迟延、任何绕航、强制卸货、转船或转运期间,以及由于船东或承租人行使根据货运合同赋予的自由权而发生任何冒险变更期间,本保险持续有效(但须受上述规定的终止及下述第9条规定的制约)。
应注意,尽管本保险责任开始生效之时与协会货物保险条款相同,亦即,自货物离开装运港仓库或贮存处所开始,本条有关风险终止的规定,对被保险人略微有利些。通常情况下,该风险持续直至:
-货物在制造厂商的仓库或贮存处所交付,或
-在目的港仓库或贮存处所满30天
被保险人的利益有某种进一步扩展,如果货物转运至超出保险单载明的目的港的范围,本保险将持续至货物被装上转运船、驳船、或运输工具或直至在目的港完全卸离海船满30天。如果期望展期,被保险人可以依第8.3款的规定获得展期。
第8.4,9和10及11至14条
第8.4,9和10及11至14条的内容与协会货物保险条款的规定一致。
第15条 仲裁条款(Arbitration Clause)
15 In the event of a dispute between the Assured and the Underwriters’ Surveyors as to the extent of the depreciation to be allowed on damaged rubber, samples shall be drawn by recognized samplers and forwarded together with the Survey Report to the Rubber Trade Association of London whose award shall be final and binding on all parties so far as concerns the extent of depreciation.

第16至20条和注意事项
第16至20条与协会货物保险条款第15至19条相对应。在该格式底部亦有一条通常的注意事项。
(八)协会F.O.S.F.A贸易保险条款(Institute Federation of Oils, Seeds and Fats Association Trade Clauses (1/7/85))与油、籽、油脂联合会的协议。
这些条款分为(A)(B)(C)三种格式。该条款除了下述两点之外,与协会货物(A)(B)(C)保险条款完全同:
-第4.6款:“破产条款”,及
-第5条:不适航与不适运除外条款
该两项条款均按我们已作解释的协会商品贸易保险条款作了修正(见第63至64页)。
自1985年7月1日起,还有下述四套补充保险条款可供F.O.S.F.A贸易使用:
1、 协会F.O.S.F.A(1号)补充保险条款(与协会F.O.S.F.A贸易保险(B)条款一道使用)(Institute F.O.S.F.A Supplementary Clause(1))
It is hereby agreed that this insurance shall also include
1 Loss of or damage to the subject-matter insured, due to breakdown or collapse of proper stow in vessel or craft caused by stress of weather, subject always to the exclusion contained in this insurance.
2 Institute Malicious Damage Clause 1/8/82.
兹同意本保险亦将包括
