PREVENTION AND CONTROL OF CORRUPTION IN THE PEOPLE'S REPUBLIC OF CHINA

 Comfucius used to say,“there are three things which a gentleman shall avoid.When young,he shall avoid too much Sex,because his sap is not yet strong.When strong,he shall avoid quarrel,because he is full of vigor.
 When old,he shall avoid covetousness,because his sap is decayed.” It seems to be a historical rule that covetousness leads people to commit a crime.In current practice in China,we can clearly see covetousness behind corruption,especially when it combines with political power.
 In the Fifteenth National Representative Committee of the Communist Party of China,that“rule of law and establish a socialist country of rule of law”has been set up to be the target of China in the new developing time.Under this general policy,China has established its strategic policy to resolve the serious problems that jeopardize the social security,of which corruption is the serious one,since Chinese people hate corruption bitterly.It states that the comprehensive way to tackle the problems of social security should be strengthened,punishment should be combined with prevention and the emphasis should be placed on the prevention,the education and the administration should be enhanced,and the system of responsibility should be put into effect,in order to create a good and healthy social security.It is obvious that the open and reform policy would not be able to carry out further,if corruption can not be put under control.The more Chinese economic and social life develop,the more changes take place in China,the stronger desire Chinese people will have to fight against corruption.
 Based upon this general policy,the comprehensive measures of prevention,halt,and punishinent shall be taken in dealing with the crimes of corruption. In these comprehensive measures,prevention is on the first important position,halt comes to the second and the third one is punishment itself.Prevention means to take measures before something happens.It is deemed as the best measure for its positive and active character.Halt means to halt the crime just happens,so that the possible enlargement of the damages can be avoided.This measure is deemed as a better emergence measure to counter the crime when it really happened.Ptmishment is the measure applicable only when the measure of halt could not have effects upon the crime happened.According to this measure,the criminals should be punished according to the taw.Here,punishment means general prevention and specific prevention.The former refers to prevent the criminal from committing any further crime.The latter refers to prevent the potential criminals from committing crimes.So,in the context of the comprehensive measures,punishment also means deterrence.However,punishment is the comparatively poor measure and should be therefor used as the last measure.These systematic measures is also in keeping with the strategic policy of combining punishment with prevention but placing emphasis on the prevention,which was established by the Fifteenth National Representative Committee of the Communist Party last year.In practice,these comprehensive measures can also be expected to yield good effects of prevention.
