10. Military vessels and aircrafts navigating in the EEZ should not install or deploy military intelligence gathering equipments in the EEZ or continental shelf of other countries. When these are found, the coastal states would have the rights to confiscate or to destroy them and to seek compensation damage as necessary. It should be noted that there is already an international convention prohibiting the implant or emplacement of nuclear weapons or any other types of weapons of mass destruction as well as structures, launching any other installations or any other facilities specifically designed for storing, testing or using such weapons ‘beyond 12 miles limit of the territorial seas’ (Articles I and II of the Seabed Treaty of February 7, 1971, which is already adhered to by more than 100 states). Since most of the continental shelf, at least within 200 miles from the baselines for measuring territorial sea, is concomitant with the EEZ, it should also be understood that the emplacement of those weapons in and under the EEZ would also be prohibited. If the emplacement of nuclear weapons is basically a military activity that could also cause environmental issues, the emplacement or deployment of other military intelligence gathering equipments in the EEZ or continental shelf of other countries should also be avoided.
11. Military vessels and aircrafts navigating in the EEZ of other countries should not interfere with or endanger the rights of the coastal states to protect and exploit its own resources and manage and protect its marine environment including monitoring, surveillance and enforcement of its regulations. The military vessels and aircrafts should not undertake marine scientific research or hydrographic survey in the EEZ of other countries, unless permitted by the relevant coastal states. It should be understood that a country that has a better knowledge of scientific nature and hydrographic data of other countries would and could have military advantages in utilizing those waters in time of crisis vis a vis other countries which have limited knowledge of the matter, including some of the coastal states themselves.
12. No military exercises or activities in the EEZ of other countries should interfere with telecommunications of coastal countries or broadcast any act of propaganda that may affect the defense or security of the coastal states. Military intelligence activities, including those using electronic signals, should not stimulates or excites coastal states to respond that in the end would only result in creating confrontation or in the depletion or exhaustion of precious resources. The exercises or the activities should be as uninviting attention and as unobtrusive as far as possible.
