  Feminist Theory & Jurisprudence
Feminist jurisprudence offers a vast variety of challenging, intriguing scholarship on women, life, and the law. Is Law male? If so - in what sense? Can law be more "feminine"? Are women significantly "different" from men or is this seeming difference merely an expression of their domination in male supremacist societies, and what role does law play in the creation of women’s status or "difference"? Can law play an active part in liberating women from the domination of men? Should it be used to "free" them from traditional roles and social identities? Is law so inherently male that it must always re-enforce patriarchy? Do women still have cohesive interests which the law can impair or promote, or are they better served being divided into separate sub-groups, each perhaps necessitating its unique analysis of the law? How does post-modern legal thought affect these concerns? Does it offer women new horizons, or does it threaten to obscure their predicaments, needs, achievements and hopes of liberation? And how should we translate all this in considering specific legally-related issues such as sexual harassment, pornography or abortion? Such dilemmas, which have an immediate relevance to our lives, have been tackled and explored by many legal feminists whose writings offer diverse points of view, emphases and conclusions. This seminar is designed to explore these questions through discussion among students from a variety of perspectives and backgrounds. Ideally, some students will be very sophisticated about feminist theory, while it will be entirely new to others. For the first half of the semester we will read some of the classic texts of feminist jurisprudence together. During the second half, we will discuss feminist approaches to specific issues.
