资源再造：法治与德治及“第三力”

【摘要】近年来，在我国社会转型的过程中出现了一些法律及道德方面的问题。党政方针及学人理论就国家治理和社会调控方面，一直在“法治”与“德治”之间寻求良方，但时至今日仍无一具体答案。问题出在哪里?面对如此凝重的“追问”．笔者试图对“法治”与“德治”本体性资源予以深入考究，通过“法治”与“德治”的优化整合，进行资源再造，创造法律、道德契合的且共享的“第三力”，来有效弥补法律的缺位和道德的无力。
In recent years，as the order of weakness of law and morality and chaos of controlling anarchism fre． quently appear in practice，the policy and principle of government and the theory of learned people concerning the govern ing of country and controlling of society have been between rule by law and rule by morality．But，there is still no definite answer．W here is the problem? acing such a severe issue，the author tries to explore the resources of natural instincts of ru le by law and rule by morality by optimizing rule by law and rule by mo．rality to remake resources，produce and share the Third Force in which law and morality are well combined to remedy effectively the vacancy of law and the powerlessness of morality．

“依法治国与以德治国相结合. ，努力建设社会主义法治国家..。”这是我们党从宏大视野上对治国方略的定论。不过，从社会学角度讲，“法治”与“德治”毕竟是两种不同的资源，“法治”与“德治”应怎样结合?“法治”与“德治”的角色应如何扮演和维度?我国“法治”与“德治”的现状如何?如此等等，这些问题未解决，“方略”无疑仅等同于空洞的El号或理想的“乌托邦”，离活生生的现实差距甚远。近年来，学界也曾针对个别问题展开过讨论，如提出：“德治与法治两极互补”，“国家治理应德法并重”，“社会主义市场经济既是法治经济，也是德治经济”等等，不过就论及而言，仍就是口号性地停留在提出问题层面上，至于“法治与德治应怎样结合”及“为什么有这种需要”等，一系列待立竿见影的关键性问题，并没有根本性地抬到桌面上来，让人总有点“不见庐山真面目”之感觉。鉴于此，笔者试图沿着这条已浮出水面但还不明去向的路径，通过对“德治”与“法治”的性能分析，探索一条“德治”与“法治”的实践结合机制。
