直面国际反倾销中的“非市场经济”问题

【摘要】“非市场经济”问题一直是困扰中国对外贸易的难题。它起源于冷战时期西方国家贸易法中处理诸如基本贸易待遇和反倾销问题时，对社会主义国家采取的一种歧视性做法。至今，美国、欧盟等西方发达资本主义国家仍视中国为“非市场经济”国家，给中国企业应对国外反倾销带来了不必要的问题，中国也一直在积极争取市场经济地位。应该认识到，“非市场经济”问题不单单是经济问题，它更多的是一个政治问题，因此有必要用政治性手段来解决，在适当的时候，应该对“非市场经济”问题有所取舍，而且，值得注意的是，“非市场经济”问题的解决也并不能完全地解决中国对外贸易的困境，要从根本上解决问题还需要中国企业自身的完善及建立国际经济新秩序。Facing directly the question of "the non- market economy" in international anti–dumping
Abstract：The question of “non- market economy" always puzzles the Chinese foreign trading. It origins in the cold war time western nation trades law processes when such as the basic trade treatment and instead dumping, to the socialist countries adopts one discrimination procedure. Until now, west developed capitalist country and so on US, European Union still regarded China as "the non- market economy" the country, the enterprise should instead dump for China bringing the nonessential question, China continuously positively has been also striving for the market economy status. To realize, what "the non- market economy" the question not merely only the economic problem, it is more a political issue, therefore the necessity to solve with the political method, in is suitable, the question should have to "the non- market economy" takes the shed, moreover, the worth noting is, "the non- market economy" the question solution also certainly cannot completely solve the Chinese foreign trade difficult position, must fundamentally solve the problem, but also needs the Chinese enterprise own consummation and the establishment new international economic order.
