【摘要】引言 由于我国当时正处于社会主义市场经济发展的初级阶段，市场发育程度较低，管理法规还不够完善，再加上交易过程中存在很大程度的信息不对称性，直销人员也具有分散性的特点，直销逐渐演变成了各种形式的传销活动。制定一部能够使消费者的权益得到充分保障，既符合我国国情，而又内外一致的直销法规，对直销业正确引导、趋利避害、稳步开放、规范发展，成为当前重要的艰巨任务。两条例的颁布对直销业确立了较为严格的监管制度。这一方面有利于保障消费者的合法权益；另一方面，也有利于直销业的发展。严格的监管制度可以尽量减少违法行为的出现，而只有合法经营，直销业的发展才能获得良好的外部环境，从而走上持续、健康发展的良性发展道路。

Two rules promulgating have established the stricter supervising and managing system to the direct sale industry. This on the one hand is advantageous in safeguards consumer’s legitimate rights and interests; On the other hand, also is advantageous to the direct sale industry development. The strict supervising and managing system may reduce the illegal activity as far as possible the appearance, but only then legitimately manages, the direct sale industry development can obtain the good external environment, thus steps onto continues, the healthy development benign development path.
