The Construction of Korea’s Offshore Fund Legal System and It’s Apocalypse to China

　　Abstract: With loosening controlment of foreign exchange, perfecting approval and administerial system, building promotive system and insurance system, the legal system Korea’s offshore fund construction greatly promoted the development of Korea’s offshore funds and multinational corporations. However, Korea also had problems such as loosening controlment blindly and supporting overly during the offshore fund legal system construction, which was becoming one of the factors of financial crisis in 1997. As China develops offshore fund, we should use Korea’s experience and lesson. China should establish Promotive Law for Offshore Fund as soon as possible, build administerial system, insurance system and fund system for offshore fund, and gradually loosen controlment of foreign exchange.
