“生产者延伸责任”立法研究-法搜-中国法律信息搜索网

　　在电子、家电和移动通讯设备领域建立生产者延伸责任制度，其责任主体是生产者和进口者，消费者只是承担不拒绝归还产品废物的义务。至于履行延伸责任的形式，应该规定生产者承担信息责任和行为责任为。生产者除了说明其产品废物的成分、最佳处置工艺外，主要应承担产品废物的回收责任，生产者或者自身承担这一义务，或者通过行业组织集中履行。政府主管部门应将行政资源集中在回收率的确定和监督生产者回收成效上。对于没有达到法定回收目标的生产者，政府主管部门应对生产者课以高于产品废物回收和处置费用的罚款，如果生产者嗣后完成了以前未完成的法定回收目标，则可以返还部分罚款，其数目应处于生产者的回收、处置费用和罚款数额之间。
