Abstract
The judicial examination system (the examination system for legal profession), accompanied with the practice of rule of law in human society, is a basic prerequisite for the institutionalized application of legal governance. A successful system must be one pursuing the optimum utility under limited conditions. The national judicial examination system in China logically reflects the pursuit of legal specialization, legal community, legal governmentalization and political civilization, as well as consequently strongly affects relevant relations concerning politics, economy and society. In view of the structural problem of institutional arrangement in society, the realization of predicted goals of the national judicial examination system rests on the interaction of a series of compatible systems.
The thesis is divided into five parts, the structure and the content are arranged as follows:
Part one, “Development and Revelation of Judicial Examination Systems in Foreign Countries”, first briefly examined the development of judicial examination systems in America, Britain, Germany, France, Japan and South Korea, then pointed out the revelation for the construction of the national judicial examination system in China;
Based on the analytical mode of institutional need and supply, part two, “Evolution of and Background Analysis of Judicial Examination Systems for Legal Profession in China”, elaborated the transformation backgrounds of judicial examination systems for legal profession in China after quickly looking back to the history of the People’s Republic of China.
Mainly to analyze the value orientation of the system, part three, “Analysis of the Values of the National Judicial Examination System of China”, not only furthered the study into legal specialization, legal community as well as legal governmentalization, but also discussed the function of the examination system during the cause of constructing political civilization from the perspective of legal governance.
